TERMS AND CONDITIONS OF BOOKING
General Jill and Richard Horswill are referred to as ‘the Owners’. The apartment is referred to as ‘the Property’. Clients applying to rent the Property are referred to as ‘the Applicants’ until such time as they take up residence when they are referred to as ‘the Tenants’. ‘Rent’ means the weekly payment to be paid for renting the Property.
Booking Applicants are advised to check availability by contacting the Owners. The booking form with terms and conditions can be printed from the website or, if required, the Owners will send a copy to the Applicant by post. Bookings will only be deemed to be accepted when made in writing to the Owners on the booking form, signed by the Applicant and accompanied by a cheque for the required amount. Telephone reservations are not regarded as bookings until the above booking conditions have been complied with.
Deposit A non returnable deposit of £100 per week is payable on booking. If a booking is made 6 weeks or less before arrival the full Rent is due at the time of the booking.
Final Payment A final invoice will normally be sent to the Applicant 8 weeks before the date of their holiday. Payment must be made in full, 6 weeks prior to the arrival date. Non payment by that date will be treated as a cancellation and the Applicant accepts that the owners may relet the property. The Applicant remains liable for the full amount, although credit will be given for any rents received as a result of reletting, less the Owners’ expenses. The same will apply to a cancellation within 6 weeks of the arrival date.
Security deposit A security deposit of £100 is charged at the time the balance of the rent is paid, to cover damage and breakages which will be refundable within 14 days of the departure date as long as no damage has been incurred. If there has been damage or breakages the amount for repair will be deducted from the security deposit.
Cancellation Insurance Applicants are recommended to take out holiday cancellation insurance.
Price changes The Owners reserve the right to amend prices quoted on the website.
Method of payment Payments are to be made by cheque made payable to Mrs J Horswill. Do not send cash. Post dated cheques are not accepted. Any charges raised against the Owners by their bank for handling cheques or converting currency will be passed on to the Applicant.
The Tenancy The tenancy confers upon the Tenants the right to occupy the property for a holiday within the meaning of Schedule 1, Paragraph 9 of the Housing Act 1988.
Tenants’ Obligations
1. To pay for any losses or damage to the property. All breakages are to be reported to the Owners or Owners‘ representatives and will be paid for at replacement cost.
2. To take good care of the Property and to leave it in a reasonably clean and tidy condition at the end of the tenancy. All personal waste must be removed from the Property. Cleaning is not provided during the tenancy unless otherwise arranged with the Owners’ representative and paid for by the Tenants.
3. Do not take furniture or any of the villa contents intended for indoor use outside.
4. To permit the Owners or the Owners’ representative reasonable access to the Property for maintenance.
5. Not to part with possession of the property or share it, except with members of the party shown on the booking form.
6. Not to exceed the total number of people stated on the booking form.
7. Not to cause annoyance or become a nuisance to occupants of surrounding apartments.
8. This is a no smoking apartment, although smoking is permitted within the grounds of the complex.
9. Towels are provided for use in the Property. Towels for use outside or by the pool are not provided.
Duration & Times of the Tenancy Tenancies are for a maximum of 4 weeks and commence at mid-day on the first day of tenancy and end at mid-day on the last day of tenancy unless otherwise agreed by the owners.
If for any reason beyond the Owners control, the Property is not available on the date booked (owing to fire damage for example) the Owners will use their best endeavours to find a property of equivalent size and quality or better on the original terms. If this is not acceptable to the Applicant, all rents and charges paid in advance by the Applicant will be refunded in full, but the Applicant shall have no further claim against the Owners.
Complaints It is important to the Owners that the Tenant has an enjoyable holiday, however in the unlikely event of a complaint or problem, the Tenant must advise the Owner or Owners’ representative immediately, so that a fair opportunity is given to rectify any difficulties. No liability for any subsequent claim will be accepted on return from the holiday.
Website Information The information contained in www.mycyprusholiday.co.uk website is believed to be accurate. Whilst the Owners take reasonable steps to ensure accuracy, they cannot accept responsibility for errors contained in the website or the result thereof. The Tenant must accept that minor differences between text & photographs and actual property may arise. All distances & times quoted are approximate and relate to travel by car.
Breach of Contract If there shall be a breach of contract of any of these conditions the Owner or the Owners‘ representative reserve the right to re-enter the property and terminate the tenancy, without prejudice to all other rights and remedies of the Owner.
Law of Contract The law governing the contract between the Owner and the Applicant/Tenant shall be the law of England.
Authority to sign The Applicant who signs the booking form certifies that he or she is authorised to agree and sign these terms and conditions on behalf of all persons included on the booking form, including those substituted or added at a later date. The signatory must be a member of the party intending to occupy the Property and be over the age of eighteen years.
DISCLAIMER
We accept no liability for accidents or injury that may be occasioned by the Tenants. Please be aware that the Apartments have tiled floors, terraces and staircases. Care should be taken at all times particularly when showering.
